Terms of Service

These Terms of Service ("Terms") are an agreement between you and Daydream Labs LLC, a New York limited liability company ("Spark", "we", "us"), governing your use of the Spark voice-translation service at spark.talk. By creating an account or using Spark, you agree to these Terms and to our Privacy Policy.

1. Who can use Spark

You must be at least 18 years old to use Spark. By using Spark, you confirm that you are 18 or older and able to enter into this agreement.

2. What Spark is — and an important safety note

Spark is an automated, AI-powered tool that translates spoken English and Spanish in real time. It is a convenience aid, not a professional interpreter.

Spark can make mistakes and may mistranslate. Do not rely on Spark for medical, legal, emergency, financial, or other high-stakes communication where a translation error could cause harm. For those situations, please use a qualified human interpreter. You are responsible for how you use any translation Spark provides.

3. Your account

You sign in through Apple, Facebook, or Google. You are responsible for keeping access to that sign-in secure and for activity under your account. Let us know promptly at hello@spark.talk if you believe your account has been used without your permission.

4. Plans, minutes, and billing

Spark offers the following plans, each including a set number of translation minutes per billing period:

Subscriptions renew automatically at the then-current price until you cancel. We will give you reasonable advance notice before any price change. Payments are processed by Stripe; by subscribing you authorize us to charge your selected payment method on each renewal.

5. Cancellation and refunds

You can cancel anytime from your billing settings. When you cancel, you keep access until the end of the billing period you have already paid for; we do not automatically refund the remainder of a period.

24-hour refund: if you are not happy with a purchase, email us within 24 hours of that purchase and we will refund it — no questions asked. If you have used more than 10 minutes of translation from that purchase, we will deduct the value of the minutes you have used (pro-rated from the price you paid) and refund the remainder. After 24 hours, payments are non-refundable except where required by law.

6. Acceptable use

You agree not to: use Spark for any unlawful purpose; use it to harass, defraud, or harm others; resell or redistribute the service; attempt to bypass usage limits or security; or copy, reverse-engineer, or disrupt the service or the systems it relies on.

7. Your content

Your conversation transcripts belong to you. You grant us permission to store and process them only as needed to provide Spark (for example, to show your history and operate the service), as described in our Privacy Policy.

8. Our intellectual property

Spark, including its software, design, and branding, is owned by Daydream Labs LLC and protected by law. These Terms do not give you any ownership of Spark.

9. Disclaimers

Spark is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that translations will be accurate or complete, or that the service will be uninterrupted, secure, or error-free. Spark depends on third-party services (including OpenAI and your internet connection) that we do not control.

10. Limitation of liability

To the fullest extent permitted by law, Daydream Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on a translation. Our total liability for any claim relating to Spark will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Daydream Labs LLC from claims and costs arising out of your misuse of Spark or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "last updated" date and, where appropriate, notify you. Continuing to use Spark after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New York.
